A design registration protects the appearance of a product or part of a product.
Designs can include the lines, contours, colours, shape, texture or materials of the product or its decoration. It could be the shape of the product, the decoration applied or both. It is the design itself which is protected by the registered design, not the product: so the packaging, containers and labels can also be protected.
It is also possible to file applications in respect of two dimensional ‘graphic symbols’. A logo might qualify as a graphic symbol, so if your brand incorporates a graphic element then registered designs can be a useful addition to the protection you get by registering your trade mark.
There are numerous ways of protecting the appearance of your designs and creations particularly if the product does not reach the technical threshold and/or originality threshold for a patent.
